Union Notices - Roles & Responsibilities for AP, BRS, ELR

1. When providing a notice of action to a represented staff or academic employee, theBRS HR Partner or the designated Dean’s office/department taking the action willconcurrently send an email to the union(s), ELR and APO (for academics only) thatincludes the final set of signed documents.

Following consultation, the HR Partner or designated Dean’s office/department will copy the union(s), ELR and APO (for academics only) on the following actions: 

  • Layoffs
  • Reductions in Time
  • Letters of Concern/Counseling (if union representative involved at this level)
  • Letters of Warning
  • Notices of Intent to take disciplinary action (e.g. suspension, demotion,termination)
  • Final Notices of Disciplinary Action

a. In the email to the union(s), include the following statement:If the union wishesto discuss this action, please contact Employee &Labor Relations.

b. Send documents to ELR using this email address: copy_elr@berkeley.edu

c. Link to the list of union contacts on the People & Culture website

d. Send documents to APO using this email address: appolicy@berkeley.edu

ELR will notice union(s) for all other actions and communications.

2. Notice distribution roles for academic represented employees – 

BRS HR Partners send notices for designated actions to the following unions:

  • Researchers/Project Scientists/Specialists (RA)
  • Postdoctoral Scholars (PX)
  • GSIs/ Readers/Tutors (BX), for departments that delegated BX titles to BRSRev 2 (5/06/21)-APO Ver 1(12/9/20)

Department/Dean's Offices send notices for designated actions to the following unions: 

  • Lecturers (IX)
  • Librarians (LX)
  • GSIs/ Readers/Tutors (BX)
  • Coordinators of Public Programs (RA)

3. Dean’s offices/departments and BRS HR Partners will send a final set of signed documents to Berkeley Regional Services (BRS) for UCPath processing.

a. For all academic actions (including actions above involving ASEs and GSRs) also send a complete set of documents to appolicy@berkeley.edu 

4. Dean’s Offices/departments and BRS HR Partners must take steps to ensure that afinal set of signed documents is placed in the employee’s personnel file.

a. A reminder to create an HR Service Hub case if files need to be sent to the BRS Records Team.

5. If the union(s) contacts ELR, the ELR team memberassigned to the case will reach outto the Dean’s office/department or the BRS HR Partner and work with them on nextsteps.
